Sky Betting & Gaming and British Heart Foundation - Terms & Conditions

These are the terms and conditions ("Terms and Conditions") that apply to The Every Minute Matters Relay (the "Relay") organised by or on behalf of, Hestview Limited, a company with its registered office at One Chamberlain Square Cs, Birmingham, United Kingdom, B3 3AX, trading as Sky Bet ("Sky Bet"). Participants in the Relay must agree to the Terms and Conditions before participating.


1. Entry Forms and Fees

a. All persons taking part in the Event (each a "Participant") must be resident in the UK and register with Sky Bet through a form provided to potential Participants to take part in the Event, but no Participant needs to have a Sky Bet account.

b. Each Participant must complete and submit an entry form ("Entry Form").

c.. Sky Bet is not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed computer or internet transmissions or other errors or malfunctions of any kind which may prevent receipt by Sky Bet  of an Entry Form.


2. Participation in the Relay

a. Participants will not receive any recompense for taking part in the Relay and Sky Bet shall not be responsible for accommodation or transport costs associated with taking part in the Relay. Notwithstanding this, Sky Bet shall provide agreed transport costs for Participants to return to the starting point of the Relay once the Relay has been completed by a participant. Participants shall be responsible for the booking and management of any of their own transportation requirements.

b. During the Relay, participants are responsible for their own welfare and route navigation whilst taking part. Event organisers will provide on ground and remote support as required.

c. In the interests of safer gambling, any Participant with a history of gambling related harm is ineligible to take part in the Relay. By agreeing to these terms, you confirm you are eligible to participate. No Participant need have a Sky Bet/Sky Betting and Gaming account, but Sky Bet will carry out a review to ascertain whether a Participant holds a Sky Betting and Gaming account and has self-excluded.

 

3. Age of Participants

 Participants must be 18 on or before the day of the event to participate in the Relay.  

 

4. Health and Fitness

a. All Participants take part in the Relay at their own risk.

b. Sky Bet shall not be under any obligation whatsoever to process, analyse or otherwise take any action on any medical information disclosed to it either during or after the registration process for the Relay.

c. All Participants agree that, as far as they are aware, they are sufficiently fit and physically able to compete in the Relay and, to the extent that it may be necessary, they have sought and relied upon any medical advice before the date that they are participating in the Relay. It is each Participant's own responsibility to assess their fitness and to ensure that they participate only if sufficiently fit. Should any medical or physical condition arise prior to the Event which is likely to affect a Participant's ability to compete in the Relay, the Participant should withdraw from the Relay.

d. Sky Bet may prevent any Participant from taking part in the Relay (either at the start of or during the Event) if Sky Bet or any medical representative considers that a Participant should not participate in the Relay for health and/or medical reasons.



5. Safety and insurance

a. Sky Bet shall take all reasonable steps to assess the safety and suitability of the Relay location prior to the Relay. Sky Bet shall also arrange for the availability of an appropriate number of first aid and/or medical personnel according to the nature of the staging of the Relay.

b. All Participants must ensure that any equipment or clothing used is in good condition and suitable for the Relay.

c. All Participants acknowledge and agree that some elements of the Relay can be considered dangerous activities, such as cycling on the highway in live traffic. Whilst Sky Bet shall take steps to ensure that the Relay takes place in a safe manner, Participants acknowledge and agree that because the Relay is taking place in public spaces, Sky Bet cannot be held liable for any damage caused outside of their direct control.

d. Sky Bet does not provide any insurance, whether life or medical or liability, for any illness, accident, injury, death, loss or damage that may arise in connection with the attendance at and/or participation in the Relay. Participants shall be responsible for arranging their own suitable and adequate insurance protection to cover their participation in the Relay, including without limitation cover:
for material loss/damage to any equipment they may use in the Relay or personal property (including clothing);

any loss or damage they may cause to a third party;

sickness; or

negligence of any party.


e. Any accident or injury caused by a Participant's actions shall be the responsibility of that Participant.

f. Each Participant is responsible for his/her actions whilst attending or participating in the Relay. This includes at the Relay start point, during the Relay and at the completion point. Sky Bet accepts no responsibility for the actions of a Participant nor the consequences of such actions.



6. Participation and Participant Numbers

a. For the Relay, Participants will be allocated a time at which they can commence the Event. Each Participant agrees that this time cannot be changed unless Sky Bet in our absolute discretion agrees to a change. Any permitted change will be made before or on the day of the Relay and in accordance with the restrictions contained in the email sent to participants in relation to the Relay.

b. Sky Bet reserve the right to reject at any time any Entry Form which is believed to be fraudulent or to disqualify any Participant who is ineligible to participate in the Relay (or if participation in the Relay should have been refused for any reason whatsoever); or who is believed to have not complied with these Terms and Conditions. Sky Bet shall not be liable in any way to a Participant who is disqualified or whose entry is rejected in accordance with this paragraph 6(b).

c. In the event that you:

i. fail to follow the reasonable instructions of the event organisers;

ii. act in a manner which the Sky Bet reasonably believes may cause offence or injury to yourself or any other person; or

iii. any other harm or safety risk;

iv. act in a manner which brings Sky Bet, the BHF  and the EFL (as defined below) into disrepute

Sky Bet reserves the right to demand that you cease to participate in the Relay.

d. Each Participant should carry a charged mobile phone with them which can be used in case of emergency, alongside any tracking device that the organisers may ask participants to carry whilst taking part in the Relay.

e. Each Participant and their supporters or spectators should not drop litter at the Relay, and instead use public or provided facilities for general waste and recycling.

f. Each Participant should be respectful of the local community, residents and/or general public whilst participating in the Relay, and not partake in any behaviour which may have a negative impact on the Relay

g. Each Participant is to refrain from using any smoking products, including electronic cigarettes at/during the Relay.

h. Each Participant is to refrain from consumption of alcohol or illegal substances prior to or during the Relay.

i. Participants for each leg must always remain together when taking part in the Relay so must cycle, run or walk as a group.

j. Participants must carry their own water and food provision for each leg of the relay. Support vehicles will be available to top up water and food supplies at designated check points

k. Particpants that are cycling must have basic cycle maintenance knowledge. In case of any mechanical issues, there will not be dedicated cycle mechanics as part of the support crew.

l. Any belongings left in the support vehicle are left at the Participant's own risk.

m. Participants will follow a pre agreed route throughout the duration of the Relay. The route will be provided via GPX file for use via participant's own GPS device or via a GPS device provided for use by the participant by Sky Bet's appointed event organiser.



7. Support Vehicle provision

a. Sky Bet will provide at least one dedicated support vehicle for each leg of the Relay.

b. Sky Bet will provide an additional roaming medical vehicle with a qualified paramedic for each leg of the Relay.

c. Support vehicles will support Participants along the route at agreed stop locations and be on hand for emergency support as required.

d. Participants will be given a phone number to contact in case contract needs to made with the support or medical vehicle.

e. Support vehicles will drive ahead to agreed locations with one support or medical vehicle always being within a maximum of 30 minutes drive of a Participant at any given time during each leg.

f. Support vehicles can carry participant belongings within a single bag, no bigger than 35 litres in size.

g. Support vehicles will carry water and basic food provision for Participants.

h. Support vehicles will carry basic cycle repair items.



8. Any Participant that is cycling during the Relay shall:

I. wear a cycle helmet which meets the British Standards Institution safety standard BS EN 1078; at all times during the Cycle Event;

II. ensure that their bicycles are in a roadworthy condition;

III. observe the rules of the Highway Code;

IV. obey the Rules of the Road (;

V. ensure that the bicycle that they use during the Relay complies in all respects with all relevant and applicable legislation including, if all or part of the Cycle Event takes place after dark, being fitted with fully functioning and adequate front and rear lights;

VI. not carry young children on their bike or carry children in a child seat, trailer or similar device; and unless the Relay Information states otherwise, must ride a two wheeled non-powered cycle in the Relay.

VII. not carry animals on their bike or carry animals in a seat, trailer or similar device.

VIII. not use any listening devices that obstruct the ear canal, including in-ear or over-ear headphones.



9. Any Participant that is running or walking during the Relay shall:

a. observe the rules of the Highway Code;

b. obey the Rules of the Road;

c. not use any listening devices that obstruct the ear canal, including in-ear or over-ear headphones.

 

 

10. Each Participant acknowledges that:

I. Participants must be at least 18 years of age on the date in which they are participating in Relay;

II. Organisers may be required to change an advertised route without notice based on any weather or road conditions observed in the days prior and on the day of the Relay.

III. Participants acknowledge there are some bicycle types and accessories that are not permitted for use by Participants that are cycling in the Relay which includes:

i. Fixed wheel bicycles with no brakes

ii. Fixed wheel bicycles with only one brake, either on the front or rear wheels

iii. Hand cycles

iv. Unicycles

v. Penny Farthings

vi. Quad cycles

vii. Cargo bicycles

viii. Specialist time-trial bicycles

ix. Trailers of any kind

x. Child carriers

xi. Triathlon, Aero, Prayer, Spinaci, Clip on or Cow handlebars

xii. Handlebars without bar-end plugs

xii. any electric bicycles/e-bikes.

11. Liability

a. Subject to paragraph 11(b), neither Sky Bet nor its agents or contractors shall be liable for:

I. any injury or accident causing loss or damage to a Participant or any third party where this is sustained as a result of a Participant taking part in the Relay; or

II. any loss or damage sustained by a Participant as a result of: the cancellation of the Relay by Sky Bet for any reason; any changes made to the Event by Sky Bet for safety or any other reasons; or any circumstances beyond the control of Sky Bet.

b. Nothing in these Terms and Conditions shall limit or exclude Sky Bet's liability in respect of death or personal injury sustained as a direct result of the negligence, breach of statutory duty or fraudulent misrepresentation of Sky Bet  its agents or contractors; or a deliberate act or omission of, Sky Bet, its agents or contractors.

c. Subject to the terms of paragraph 12 below, Sky Bet shall not be liable for any loss or damage sustained by a Participant as a result of: the cancellation of the Relay by, Sky Bet for any reason; any changes made to the Event by BHF, Sky Bet for safety reasons; or any circumstances beyond the control of Sky Bet.

d. Nothing in these Terms and Conditions shall affect any statutory rights to which the Participant may be entitled as a consumer.

12. Withdrawal

Participants wishing to withdraw from the Relay must send written confirmation of their withdrawal via email to the Sky Bet email address contained in the email sent to participants with information related to the Relay.

13. Cancellation and changes to the Relay

a. In the event that Sky Bet is forced to cancel the Relay for any reason, Sky Bet will notify affected Participants as soon as possible.

b. If Sky Bet gives notice under paragraph 13(a) to cancel an Event in the UK then affected Participants will not be entitled to a refund of their associated travel or accommodation costs.

c. Sky Bet reserve the right to alter the date in which a participant takes part in the Relay, start time or other details of the Relay, as required. If changes to the Relay are made, Sky Bet shall contact the affected Participants directly as soon as reasonably practicable.

d. In the event of a change of the Relay Date, Participants will have the right to withdraw from the Relay

14. Photos and Publicity

a. Legitimate Interest: Photographs and films will be taken throughout the Relay by Sky Bet or their group companies and/or their contractors and/or their agents by relying on legitimate interest as a lawful basis for doing so. Sky Bet need the ability to use your photographs and films to promote and report on  the Relay by means of film, television, radio, print media, internet, publicity material or any other media now or in the future.

b. By taking part you confirm you are happy for any photographs or films taken during your participation in the Relay to be used by, Sky Bet and the Relay partners, the BHF and the EFL for the reasons as stated in 14.a. Sky Bet will not, however, identify anyone by name without their consent. If a Participant prefers that Sky Bet, the BHF and/or the EFL do not use any such images in which you may appear, please contact Sky Bet one week in advance of the date in which you are due to take part in the Relay on SkyBetEFLRelay@flutteruki.com. Sky Bet's use of the Participant's photograph and/or personal information contained in stewardship or marketing will be in accordance with the Sky Bet's privacy policy.

c. All Participants acknowledge and agree that no payment will be made to any Participant for the use of any photographs, images or films in which they may feature.

15. Data Protection

a. Each Participant agrees that information provided to Sky Bet in connection with Events is true and accurate in all respects and may be used by Sky Bet in accordance with prevailing data protection legislation.

b. Sky Bet will use the information provided by Participants to manage, organise and administer the Event and the Participant's involvement in it. Data may be shared by Sky Bet with the partners referenced in clause 17(d), in accordance with the privacy policy found here.    

c. Each Participant will agree to provide emergency contact information when registering for the Relay.

d. Sky Bet reserve the right to pass all information provided by a Participant to the event organisers and any first aid organisation or medical provider attending and assisting at the Relay ("Medical Provider") for safety purposes. This is to enable the Medical Provider to:

I. administer first aid in the event that a Participant suffers illness or injury during the Relay; and

II. to contact the friends or relatives of a Participant, where necessary.

e. Each Participant authorises any Medical Provider to administer first aid treatment or any medical treatment to the Participant or to transport the Participant in the event of any illness, accident or injury suffered by the Participant in connection with his/her participation in the Relay.

f. Each Participant agrees that any Medical Provider may provide Sky Bet with:

I. the names of any Participant that they treat during the Event together with details of the circumstances surrounding that treatment; and

II. the name of any Participant who notifies the Medical Provider that they are withdrawing from an Event due to ill health or otherwise.

g. Each Participant authorises the Sky Bet and its partners to store and use your personal information (including Participant number and finish time) solely in relation to the organisation and administration of the Event.

16. During the Relay

a. All Participants must abide by all rules relating to the Event set out in the Event Information and any instructions given by Sky Bet, their employees or agents before, during and after the Event. Failure to follow any such rules or instructions may result in Sky Bet refusing to allow the Participant to continue in the Event. Participants must retire at once from the Event if ordered to do so for any reason by Sky Bet, their employees or agents, any member of the Event's official staff, medical staff or any government authority.

b. No illegal substances, performance enhancing substances or intoxicants of any kind are permitted to be brought to the Event or used by Participants either before or during participation in the Event. BHF reserve the right to refuse attendance at, or participation in, the Event by any Participant found to have consumed or to have in their possession any illegal substances, performance enhancing substances or intoxicants of any kind.

c. Participants acknowledge that Sky Bet require Participants to reach certain points in the Event by specific times or require the Event to be completed in its entirety by a set time. If a Participant does not manage to keep up with any stage or completion time, Sky Bet reserves the right to refuse to allow the Participant to continue in the Event. If the Event has staging or completion times, these will be set out in the Event Information, communicated in emails, or stated on the day of the Event.

17. Acceptance of these Terms and Conditions

a. By registering to participate in the Relay, a Participant agrees to be bound by these Terms and Conditions.

b. If any provisions in these Terms and Conditions, whether in full or in part, is held to be invalid or unenforceable, all other remaining provisions (in full or in part) shall continue to be valid and enforceable.

d. These Terms and Conditions and any dispute or claim that arises out of or in connection with them is governed by and construed in accordance with English law. The English courts have exclusive jurisdiction to settle any dispute or claim that may arise out of or in connection with these Terms and Conditions.

The Relay is organised by Hestview Limited, a company with its registered office at One Chamberlain Square Cs, Birmingham, United Kingdom, B3 3AX, trading as Sky Bet ("Sky Bet"). The event organiser nominated by Sky Bet is OBE London Limited with its registered address at C/O Cox Costello & Horne, Batchworth Lock House, 99 Church Street, Rickmansworth, England, WD3 1JJ. The British Heart Foundation, a charity with its registered office at Greater London House, 180 Hampstead Road, London NW1 7AW and The Football League Limited a company with a registered address of EFL House, 10 - 12 West Cliff, Preston, Lancashire, PR1 8HU are partners of Sky Bet in relation to Relay but are not responsible for its organisation. The PR agency nominated by Sky Bet for promotion of the Relay is Lansons Communications Limited with its registered address at 24a St John Street, London, EC1M 4AY.
